SHORT TERM RENTAL AGREEMENT
Defined Terms
Some terms used throughout the Agreement have special meanings. These are defined terms. Defined terms are capitalized each time they are used. Certain defined terms are below:
Renting Party - The individual requesting and paying for rental access to the property as the undersigned in this agreement.
Guest(s) - The Renting Party and any individuals listed on the guest list in the agreement.
Management - legal representatives of Luna Wolf Lodge, LLC
Security Personnel - An individual authorized by Management to enforce the terms of this agreement in the best interest of Management and its property.
Rental Period - The start date, end date, and time the Guest(s) may access the property.
1. Rental information
1.1 Guest list
Total people in renting party is not to exceed 12 individuals including children and adults. An email will be sent to the Renting Party requesting the provide Management with a guest list, that includes the name and age of every individual who will be staying on the property.
1.2 Rental Period
The rental period begins at 4:00pm on check-in day and ends at 11:00am on check-out day.
1.3 Cleaning Fees and Security Deposit
Cleaning Fee:
A cleaning fee of $150.00 is charged as a part of your stay to clean the property upon your departure. This cleaning is considered a property turn over. Guest(s) are required to perform all tasks on the check-out checklist in the property handbook to avoid a "deep clean fee" being deducted from their security deposit.
Security Deposit
A Security Deposit of $300 will be charge to your card 2 days before arrival. Your security deposit will be refunded on 7 day after your departure less any charges for damages or repairs incurred during your stay according to the terms of this agreement.
2. Terms of the Agreement
2.1 Property Access
The Guest(s) shall only access the property within the Rental Period. The Guest(s) waive all rights to process if they fail to vacate the premises upon termination of the rental period.
a. Risk of Eviction
Should the Guest(s) violate any terms of this agreement, the Guest(s) access will be immediately revoked resulting in eviction and forfeit all monies paid.
b. Management Access
Management and/or Security Personnel have the right to inspect the premises without prior notice at any time to enforce the terms of this agreement.
2.2 Security Deposit and Property Damages
The security deposit is collected to protect management against maintenance or repairs as the result of damage or misuse of the property or any of its assets while present on the property, inside or out of the Rental Period.
Guest(s) will be charged for any maintenance and repairs should the property and its premises be left in a lesser condition. Guest(s) acknowledges and agrees that the Management shall deduct costs of said maintenance and repairs from the security deposit prior to refund.
Including but not limited to:
Broken furnishings
Missing or stolen furnishing
Labor to move furniture back to it’s location prior to Guest(s) Rental Period
2.3 Rental Authorization
This agreement authorizes the Guest(s) and the individuals on the guest list access to the property during the Rental period. Guest(s) have NO RIGHT to sublet the property.
2.4 Cancellation and Refunds
Full refund for cancellations up to 30 days before check-in. If booked between 30 and 14 days before check-in, full refund for cancellations made within 48 hours of booking. After that, 50% refund up to 7 days before check-in. No refund after that.
To cancel a reservation the Renting Party must e-mail Luna Wolf Lodge at support@lunawolflodge.com of their inability to rent and reason for cancellation. Upon review, a refund will be issued to the original source of payment.
No other refunds will be given for a Guest(s) stay, this includes but is not limited to:
a. Power or Internet Outages
The property resides in a rural area of Oklahoma and occasionally experiences power, internet and cable TV outages that are beyond Management control. Management will report outages as each occurs and will communicate with the Guest(s) whatever information we receive from the corresponding vendor.
b. Family or Medical Emergencies
Shortened stays or ruined experiences due to work and family emergencies or other commitments.
c. Weather
There shall be no refunds due to shortened stays or ruined expectations because of weather conditions.
d. Amenities
The property has an array of amenities ranging from interior and exterior. Management and Management personnel work to ensure all amenities advertised are preset but cannot guarantee any amenity advertised.
2.5 Property Guidelines
The following is a non-exhaustive list of guidelines for property usage. Management and its security personnel retain the right to evict a Guest(s) for misuse of the property at any time.
1. Max Occupancy
The Guest(s) will have no more than 12 (twelve) persons reside or sleep on the premises. This includes all infants, toddlers and adults. Over occupancy is grounds for immediate eviction and forfeiture of all monies paid.
2. Lawful Use
Guest(s) shall use the property for legal purposes only. Other uses, such as but not limited to illegal drug use, abuse of any persons, harboring fugitives, etc; are expressly prohibited.
3. Pets
No pets of any kind will be brought onto the premises. If any pet is found to be on the premises, this agreement will be considered breached, the Guest(s) will be evicted and asked to vacate the premises immediately. An additional fine of $500 will be due immediately. You will forfeit your security deposit and all other monies paid.
4. Noise and Quiet Hours
The Guest(s) shall behave in a civilized manner and respect the surrounding property owners by observing Quiet Hours and Noise Restrictions. Guest(s) agree to reduce outdoor noise, including but not limited to, yelling, music, and vehicle noise between the hours of 10:00pm and 7:00am.
5. Septic System
Do not flush any item down the toilet other than toilet paper. The property is serviced by septic and it is imperative that appropriate amounts of toilet paper be flushed. If Guest(s) should cause an issue with the septic system during their stay, Guest(s) shall incur a service fee of $150 to cover the costs of service call to assess the issue. Guest(s) will be liable for any damage or repair found to be caused by their misuse of the septic system.
6. Cable TV Boxes & Internet Routers
There are cable tv and internet routers throughout the property. There will be a $250 fee for every cable box or internet router that is disconnected during a Guest(s) stay.
7. Air Conditioning
The HVAC controls will be kept within a range of 68-78 degrees respectively. Management has remote access to the HVAC controls and will enforce these limits remotely if necessary.
Doors and windows shall remain closed when either heat or air conditioning is in operation.
Removing the thermostat from the wireless internet is considered grounds for eviction and forfeiture of all rent and monies paid.
8. Departure Condition
Before departure, the Guest(s) shall follow the departure instructions that are present in the Guidebook and provided via email.
9. Parties
Open and/or private invitation parties inviting individuals not of the guest list are not allowed. The occupancy should never exceed the Max Occupancy rules.
10. Firearms
Only legally owned and permitted firearms shall be allowed on the premises according to State and local laws. The discharge of firearms is not allowed on the property. This includes pellet guns and paintball guns.
11. Fireworks
Fireworks and other hazardous materials shall not be used in or around the property.
12. Unaccompanied Minors
A responsible party, 25 years of age or older, shall be on the premises with any and all underaged guests.
13. Food and Trash
Dispose of all trash and waste material generated during the rental period in a lawful manner and put in the trash cans located at the end of the circle driveway for pickup. Trash pickup is on Monday, Wednesday and Friday mornings. Refrigerator & freezer shall be completely emptied upon guests departure.
14. Fire Pit
Do not throw any embers, logs or debris from fire pit onto the ground or into trash receptacles. Please leave all embers and ash in the fire pit.
15. Furniture
No Indoor furniture shall be moved outside.
16. Trees
Guest(s) shall not remove, chop down or trim ANY trees or foliage.
17. Parking
Guest(s) shall not drive across or park on any area of the property that is not designated for vehicles and shall not drive on/across or park on any neighboring property.
18. Smoking
There shall be no smoking or vaping inside the premises or on the property decks. Smoking or vaping is permitted on the exterior a minimum of 5 feet from property so that smoke does not enter the interior. All smoking waste and paraphernalia shall be extinguished and thrown away in an exterior trash can.
19. Hot Tub
No chemicals, soaps, or bath bombs are to be placed in the hot tub. Management will prep the hot tub prior to your stay. Hot tubs are known to irritate sensitive skin. Use is voluntary and at your own risk.
2.6 Amenities
Management shall provide towels, linens, cups, knives, forks, spoons, dishes, and other items as commonly used by the Owner’s family. Toilet paper, paper towels, dish soap, laundry detergent, trash bags are also provided. All items listed should be provided but are not guaranteed.
2.7 Attorney Fees
Guest(s) agree to pay all reasonable costs, attorney’s fees and expenses that shall be made or incurred by the Management or Security Personnel during the enforcement of this agreement.
2.8 Transient Occupancy
Guest(s) expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Guest(s) have no right to make the property a residence or household. Management adheres to all state and local laws and ordinances in regards to transient occupancy.
2.9 Fire Safety
The Guest(s) agrees to adhere to all fire safety precautions and rules.
1. Extinguishers
The property has a fire extinguisher located under the kitchen sink and installed outside near the fireplace. The fire extinguishers were fully charged at last inspection. It is the duty of the Guest(s) to inform management immediately should the fire extinguisher be used. Guest(s) agrees to use the fire extinguisher only for true emergencies.
2. Smoke alarms
The property has smoke alarms installed and they are believed to function properly at the time of the rental. Guest(s) will notify Management without delay if a smoke alarm “chirps” or has a low battery condition.
3. Carbon Monoxide
Guest(s) is advised that there is a carbon monoxide detector inside the property and shall notify management if it malfunctions or an alarm sounds and notify the appropriate emergency numbers.
2.10 Security
The property is secured by AGEIS Security. AGEIS and its personnel are authorized to act on behalf of Management to enforce the terms of this agreement, including physically removing tenants upon breach of agreement.
1. Personal Security
Guest(s) shall see to their own security while on the property by locking all doors, windows, etc. of the cabin and personal vehicles.
2. Left or Lost items
Valuable items left behind by Guest(s) will be held for the tenant and every reasonable effort will be made to contact the Guest(s) for return. If items are not claimed for longer than 6 months they shall become the property of the Management. The Management shall not be held liable for condition of said items.
3. Property Cameras
Guest(s) acknowledges that Management maintains exterior security cameras on the property for the safety and security of the property and our guests. Security camera are focused on the property egress capturing 24/7 video. The cameras are capable of video and audio capture but audio is only captured when the property is vacant.
2.11 Indemnification and Insurance
The Guest(s) shall hereby indemnify and hold harmless the Management against any and all claims of personal injury, property damage or loss arising from the use of the premises regardless of the accident, injury or loss. Management expressly conveys that any insurance for property damage or loss which the Management may maintain on the property does not cover personal property of the Guest(s), and that Guest(s) should purchase their own insurance if such coverage is desired.
2.12 Authorization to rent
The Renting Party must be at least 25 years of age, and provide management with a copy of a valid driver license.
1. No Third-party Reservations
Third party reservations, or when a person(s) over 25 years of age acquires a rental on behalf on another individual is expressly prohibited.
2.13 Severability
The provisions of this Agreement shall be deemed severable and the invalidity or unenforceability of any provision shall not affect the validity or enforceability of the other provisions hereof. If any provision of this Agreement, or the application thereof to any Person or any circumstance, is invalid or unenforceable, (a) a suitable and equitable provision shall be substituted therefor in order to carry out, so far as may be valid and enforceable, the intent and purpose of such invalid or unenforceable provision and (b) the remainder of this Agreement and the application of such provision to other Persons or circumstances shall not be affected by such invalidity or unenforceability, nor shall such invalidity or unenforceability affect the validity or enforceability of such provision, or the application thereof, in any other jurisdiction.
